With the three-year anniversary of Superstorm Sandy approaching, nearly 73 percent of storm-related lawsuits have been settled. Although big-dollar claims may still be brought by policy-holders who previously attempted to negotiate out of court, the extra judicial attention given to claims by the state court has helped to move cases along. Based on instructions by Chief Justice Stuart Rabner, trial courts expedited Sandy cases through various administrative measures.
This was helpful in moving things along in the courts, according to Charles Yuen, Scarinci Hollenbeck Partner and Chair of the firm’s policyholder-oriented Insurance Recovery and Liability Group. In a recent Law 360 Article about the progress of Sandy suits, Yuen, who has handled a number of Sandy cases in Monmouth County, noted that “By being attentive and keeping deadlines, the court administration has been extremely helpful in getting cases moving and resolved.”
Yuen further noted that one factor in how long a case lingers “hinges on insurers determining the availability of reinsurance coverage.”
