Is the NJ Solar Industry Headed for Collapse?

New Jersey is planning to overhaul the way it approaches solar energy and end the existing solar renewable energy certificate (SREC) program used in part to finance solar projects. The value of SRECs — awarded for each megawatt-hour of electricity generated from a solar energy installation — has fluctuated significantly in recent years. After crashing six years ago, the market is rebounding. However, without an interim system for incentivizing solar development while the new program is put in place, solar advocates are warning that the New Jersey solar industry could again be in trouble.

Historic Property Reinvestment Act Seeks to Incentivize Historic Preservation in New Jersey

New Jersey developers and homeowners could be eligible for tax credits under new legislation that seeks to encourage the rehabilitation and preservation of historic properties. If the legislation becomes law, New Jersey would join 35 other states that already have historic rehabilitation tax credits in place.

NJ Appeals Court Rules Tenant Can Be Evicted for Sub-Tenant’s Damage

New Jersey landlords can evict a residential tenant for damage caused by a sub-tenant, according to a recent decision by the Appellate Division of the New Jersey Superior Court. In so ruling, the court rejected the tenant’s argument that only the subtenant could be evicted under the Anti-Eviction Act, which authorizes a landlord to regain possession of leased premises by proof of willful or grossly negligent conduct that "caused or allowed destruction, damage or injury to the premises."

Scarinci Hollenbeck is pleased to announce that retired Superior Court Judge, Ronald Lee Reisner, J.S.C. (Ret.), has been selected to be on the Board of Trustees of the U.S. Attorney’s Office Alumni Association for the District of New Jersey. Judge Reisner, who joined the firm  after serving fifteen years as a Superior Court Judge in Monmouth County, is also a Trustee for HABcore, Inc. HABcore is a charitable organization which provides permanent and supportive housing for homeless veterans, families and individuals with special needs.

New Jersey Environmental Attorneys Successful in Office of Administrative Law

Scarinci Hollenbeck is pleased to announce that John M. Scagnelli and William A. Baker of the firm’s Environmental Land & Use Law Group achieved a successful result on behalf of R&K Associates, LLC a case tried in the Office of Administrative Law (“OAL”) and upheld in a Final Decision by Katherine R. McCabe, Commissioner of NJDEP.  The case is captioned R&K Associates, LLC v. New Jersey Department of Environmental Protection and Des Champs Laboratories, Inc., OAL Dkt. No. ESR-13443-17.  To date, there have been three Appellate Division decisions, an OAL trial and an OAL hearing.
