Is It Time to Restrict Your CEO’s Twitter Account?

Tesla founder and CEO Elon Musk recently drew the ire of the Securities and Exchange Commission (SEC) when he tweeted to his 22.3 million followers on Twitter that he was planning to take his company private. On August 7, 2018, Musk tweeted: “Am considering taking Tesla private at $420. Funding secured.” Following this tweet, Tesla’s stock price jumped by over six percent, a significant impact on the market that many attributed to the tweet. The impact was keenly felt by short-sellers, with whom Musk had been feuding.  Tesla later confirmed that a final decision about taking the company private had not yet been reached.

Thankfully, that will soon change. According to NJDEP Commissioner Catherine McCabe, the agency is preparing to unveil a new electronic submission system.

Will SCOTUS Decide Groundwater Contamination Liability Under Clean Water Act?

It is increasingly likely that the U.S. Supreme Court will intervene to resolve disputes over the limits of groundwater contamination liability under the Clean Water Act (CWA). A circuit split recently developed with the Sixth Circuit Court of Appeals ruling that two power plants did not violate the CWA when contaminants from their coal ash ponds leached into the local groundwater.

New York employers should be aware that a key compliance date is quickly approaching. Starting on October 9, 2018, employers must satisfy new minimum standards for sexual harassment prevention policies and training. The New York Department of Labor (NYDOL) has published draft materials, including a model sexual harassment prevention policy and model sexual harassment training guide, which should be finalized in the coming weeks.
