Ronald S. Bienstock, Scarinci Hollenbeck partner and Chair of the firm’s Intellectual Property and Entertainment, Media & Sports practice is featured in an Electric Guitar Design Book entitled Electric Guitars: Design and Invention—The Groundbreaking Innovations That Shaped the Modern Instrument by respected guitar expert Tony Bacon.
Bienstock, who is a recognized expert in this field, was tapped for his expertise based on his work within the musical instrument industry and his many landmark wins for the guitar industry, the most famous being an unprecedented victory against Fender Musical Instrument Corporation. Representing 17 guitar manufacturers in the trademark opposition proceeding against Fender, Ron successfully argued that Fender should not be allowed trademark registrations to three guitar and bass body shapes.
In Bacon’s book, Bienstock noted that the law about guitar design it is often misunderstood and regularly “garbled.” He pointed out that people confuse the three areas of intellectual property [copyrights, trademarks and patents] when it comes to the musical instrument industry. “Many people use the word copyright interchangeably with trademark and patent. They are different.”
