Pinguelo, Chair of its Cyber Security & Data Protection and eDiscovery groups, is slated to be a speaker and panelist at the New Jersey State Bar Association’s Annual Meeting and Convention. Pinguelo will join a group of esteemed panelists in a roundtable panel program titled “”Recent Legal & Technological Developments in E-Discovery: What Every State and Federal Practitioner Should Know,” hosted by the Federal Practice Section of the New Jersey State Bar Association. The program will be held on May 16, 2013 at the Borgota Hotel Casino & Spa in Atlantic City.
In addition to Pinguelo, the panel will consist of the Honorable Garrett E. Brown, Chief Judge, U.S. District Court (District of New Jersey) (retired) and the Honorable Tonianne J. Bongiovanni, Magistrate Judge, U.S. District Court (District of New Jersey). Further,Jennifer Marino Thibodaux, Esq. of Gibbons, PC and Matthew F. Knouff, Esq., General Counsel and E-Discovery Counsel of Complete Discovery Source will round out the panel.
The program will explore important technological and legal developments in e-discovery, such as predictive coding, recent decisions concerning the use of search terms, preservation obligations, and social media, as well as, other subjects to be developed in consultation with the panel and members of the audience.
Fernando Pinguelo devotes his practice to complex litigation with an emphasis on crisis management and business disputes, cyber security, electronic discovery (eDiscovery), media, and employment matters. He has experience in all facets of litigation (trial, mediation, arbitration, and appellate) in both federal and state courts. Pinguelo handles a broad spectrum of disputes, including business torts, data breaches, misappropriation of trade secrets, copyright infringement, fraud, and breach of non-compete covenants. He is effectively able to address a rapidly evolving crisis or emergency for business.
A leader in the emerging areas of cyber law and eDiscovery, Pinguelo works closely with business executives, in-house counsel, HR, and IT managers to develop strategies for managing business and legal issues relating to electronic data. He focuses client attention on preventing claims and pursues strategies that enhance a client’s ability to manage data – essential precautions because of the financial and public relations fallout that often results from high-profile data breaches. Recently, Pinguelo provided commentary on proposed U.S. federal legislation concerning cyber security, and received a Fulbright Specialist appointment for his work in eDiscovery. Pinguelo was involved in New Jersey’s first case addressing its new eDiscovery rule amendments; designed one of the first eDiscovery law courses in the country, which he teaches at Seton Hall University School of Law.
